What qualifies as a DUI in Florida?

In the United States, it is illegal for anyone to drive under the influence of alcohol or other chemical or controlled substances. In Florida (and most other states), the legal BAC limits are:

  • A person is legally impaired if their BAC is 0.08% or higher.
  • For commercial drivers, the legal limit is lower, at 0.04% BAC.
  • For drivers under the age of 21, the legal limit is 0.02% BAC.

Even if a person’s BAC is below 0.08%, they can still be charged with a DUI if law enforcement determines that their normal faculties (such as vision, balance, coordination, judgment, etc.) are impaired by alcohol, drugs, or other chemical substances.

Penalties for a DUI

After a DUI arrest, you will immediately lose your driver’s license. Depending on your criminal history, you may be eligible to get your driver’s license back for work purposes only. The long-term penalties for DUI vary from case to case. For some, they include fines and driver’s license suspension, while others may incur jail time.
